In his very last decision on the Supreme Court, retiring justice Anthony Kennedy joined with the conservative majority to uphold President Trump’s travel ban against travelers from Syria, Iran, Libya, Sudan, Somalia and Yemen. American Civil Liberties Union National Legal Director David Cole excoriated the court in general and Kennedy in particular in the pages of the New York Review of Books, saying the court “looked away” and “That the court was unwilling to rule against the president in such egregious circumstances does not portend well for the future of the separation of powers.”
